In compliance with Law 7/1996 of 15 January, related to the Retail Trade Management, we inform you that all purchases done in catalogo.hepoluz.es are subject to what is established in the General Buying Conditions showned in this document.

If you follow the required steps to formalize a purchase, you are confirming a full adherence without reservation to all the General Buying Conditions which are published in that precise moment, and also to the particular conditions that can govern the acquisition.

Sending this purchase form means a way of contracting. The right sending of the aforementioned form produces full legal effects concerning the effectiveness and validity of the contracts.

The present general conditions have been created in compliance with Law 34/2002 of the Society of Information and Electronic Market Services, Law 7/1998 about the General Contracting Conditions, Royal Legislative Degree 1/2007 of 16 November, which contains the approval of the consolidated text of the General Law for the Consumer and User Protection, and also the provisions derived from it.

Hepoluz S.L. reserves the right to modify at any time the present general buying conditions.

With the web portal catalogo.hepoluz.es, Hepoluz S.L. located in Calle Fustería, 2, San Vicente del Raspeig (Alicante) Spain CIF: B03868072, contact phone number 965677060 and e-mail hepoluz@hepoluz.es, offers its users the possibility of acquiring products related to lighting, electricity, tools, gardening, plumbing and homeware

1.- Contracting capacity

It is forbidden to contract services and/or the acquisition of products to the users who don't have legal capacity for contracting according to their national laws.

Contracting services and/or the acquisition of products is exclusive for the professionals of the retail sector.

2.- Aim

This Portal has been developed in order to offer information about products related to lighting, electricity, tools, garden, plumbing and houseware, and also for the distribution of these products managing their acquisition via electronic means.

3.- Terms of use

The access to the Portal does not imply your register as new user, however the aforementioned complete register is necessary to carry out the buying process of the products offered in the website. The register can be done by the form which is available in our website or with one of the members of our commercial team who you can request by calling to the contact phone number. The information contained in the form will be validated and the default risk index will be evaluated, once it is accepted you will be sent the password by e-mail. You will be able to see the information that you provided in order to buy at any time. Likewise, once you have an account as client of Hepoluz S.L., you will be able to update your information at any time and check the operations performed.

The user is responsible of the security and confidentiality of his or her account in order to avoid the access of non authorized third parties. You will be responsible of all the operations and transactions performed with it. Any person, identified by entering your user name and password will be considered valid. We will not be responsible of any operation performed as a result of an improper use of your user name and password by third parties. Likewise, the user agrees to perform a proper use of the Portal and refrains from acts which are contrary to the current legislation.

4.- Buying system

A reference to the main features of the products and their price (taxes not included) will appear next to the image of the products on the screen.

The purchases performed in this Portal are limited to the Iberian Peninsula, the Canary Islands, the Balearic Islands, Ceuta, Melilla and Andorra, so we ask you not to place orders that do not comply with this requirement. Otherwise, your order will not be attended.

Once you have been registered and our privacy policy and legal clauses have been accepted, all the steps required to start buying will be shown. The user must simply follow the instructions. During this process, you will determine the billing information and delivery details and the delivery date with a maximum of 4 calendar days from the date your order has entered . The payment option can be done by: Paypal, credit or debit card, or the modality negotiated with Hepoluz S.L.

Once the present conditions have been accepted and the purchase is finished and before the confirmation of your order, you will be able to check the summary of the purchase, with the possibility of modifying the information provided by you at any time, that will always contain the product price (taxes included) and the description of the acquired products, choosing later the payment option that can be done by Paypal, credit or debit card, or the one negotiated with Hepoluz S.L. Likewise, in period not longer than 24 hours, you will receive a confirmation e-mail with all details.

In order to formalize the acquisition of the products, the user must be logged in by pressing the "Access" (in the "Log in" option) expressly agreeing the privacy policy of the company. Once logged in, the user will be able to update the "Shopping cart", adding or removing products, being able at any time of the description of the purchase at any time. If everything is right, once the purchase is done, the general buying terms have been accepted and the payment option is selected, the user must press the place order button, confirming the purchase.

In the summary of the purchase you will see the product price (taxes non included), the total amount of the applicable taxes and the total amount of the purchase. The payment will be done in the moment the purchase is done.

Once you have given us your data during the purchase process you declare to be the owner of these data and responsible of their veracity. If you do not comply with this obligation, you will be held responsible of the possible damage and loss caused to Hepoluz S.L.

The promotional products will appear identified and marked as such, their period of validity will be effective while they appear here or the one provided.

Before your order is confirmed you will be able to see again all your data and acquired articles. Thus, you have the possibility of check mistakes in the data or articles. Once, they have been verified you can accept the purchase operation, once you have previously accepted the general buying terms. The terms can be read at any time by the link provided in the web next to the legal notice and the privacy policy.

The contracts will be in Spanish. The electronic document in which the contract is formalized will be kept during the legal statute of limitations in order to meet the criteria of our legal or contractual obligations for legal reasons and exercise or defense of possible claims.

5.- Applicable taxes

The prices of the products shown in the Portal catalogo.hepoluz.es do not include all the taxes applicable on them. The amount of the applicable taxes will be shown at the bottom of the summary of the purchase.

6.- Payment options

The payment options for our customers can be done by credit or debit card, Paypal or the one negotiated previously with Hepoluz when the purchase is made.

Hepoluz S.L. reserves the right to suppress the payment option negotiated in case the credit of the user has been closed according to the report of the credit insurance company Crédito y Caución, if this is the case, purchases can only be made by Paypal or credit or debit card.

7.- Delivery Date

The delivery will take place on the adress indicated by the customer in 24/72 hours, never more than 10 calendar days with the exception of those products that due to their particular fabrication and distribution features require a longer delivery date, in these cases the customer will be informed. We will contact you to tell you these particular delivery dates. The saler will not be responsible if you are absent when the delivery takes place, a document will be left informing you about the visit and about a new delivery date after contacting you. The saler will not also be responsible when the order cannot be delivered due to mistakes or inaccuracy in the data provided by the client, who will be contacted in order to mend the mistakes. Once these incidents are solved, the delivery will take place.

The owner accepts as his or her own the signature of any person in his or her name and in the adress provided gets the delivery.

Hepoluz S.L. will not be responsible of the occassional typographical errors that can be in the Portal, however the company will try to detect any kind of error that may appear in the features or prices of the products and correct them immediately.

8.- Obligations of the client

The client of catalogo.hepoluz.es is committed to provide true information regarding the data requested in the register forms. The client is also committed to keep them updated via the open account in the portal or contacting Hepoluz S.L. by any of the proper ways indicated.

Hepoluz S.L. is not responsible of the problems or noncompliances that may take place as a consequence of wrong or outdated data from the client.

All the operations performed by Hepoluz S.L. will be done according to the information provided by the customer, who must collaborate in the necessary arrangements or explanations for the proper functionning of the service.

9.- Legal guarantee

In the case of lack of conformity of the products with the contract, the client must inform Hepoluz S.L. in order to proceed to their replacement or reimbursement in the legally established terms.

10.- Notification and contact

Any notification or comunication between the parties regarding the General Buying Conditions can be done in written form and sent by mail or by the contact e-mail.

11.- Management of claims and complaints

Any explanation, suggestion, claim or complaint can be adressed to our customer service by:

12.- Legislation and Jurisdiction

These General Buying Conditions are governed by the Spanish laws.
In the case of a dispute, the parties will be subjected to the Courts corresponding to the customer's adress.
